In the state that an optical pickup 3 is held stopped in a data region on the optical disk, an amplitude Vdpp by a DPP system and an amplitude Vdpd by a DPD system are acquired as a tracking error signal by a TR signal generation section 9. A disk discrimination section 10 discriminates the kind of the optical disk by comparing the acquired Vdpp and Vdpd with a threshold Vth. Otherwise, in the state that the optical pickup is held stopped in a data region and system lead-in region on the optical disk, the amplitude Vdata and amplitude Vlead of the tracking error signal are acquired and are compared.
