Disclosed are a touch circuit having an electrostatic protection structure and a touch panel, which relate to the field of electronic equipment manufacturing. The touch circuit having the electrostatic protection structure comprises: a signal transmission channel and a grounding channel; a tail end of the signal transmission channel is provided with a first tip structure which projects outwards and has a needle tip-shaped top end; the grounding channel is provided with a second tip structure of which a needle tip-shaped top end is opposite to that of the first tip structure; the needle tip-shaped top end having the first tip structure on the signal transmission channel is used for gathering electrostatic charges on the signal transmission channel, and releasing the gathered electrostatic charges to the second tip structure which is opposite to the first tip structure and is located on the grounding channel. The problems that via the adding of an electrostatic protection device, only the electrostatic charges are blocked, and the touch circuit will also be damaged when too many electrostatic charges are gathered are solved; the effect of increasing electrostatic resistance about the touch circuit is achieved.
